The RIAA has gotten more and more out of control since the beginning of this whole suing people for downloading music started.
RIAA attorney Richard Gabriel told reporters after the trial judgement of Jammie Thomas [a 30 year old single mother who lives in Minnesota and who may or may not have shared music by having it on her hard drive] "This is what can happen if you don't settle... ...I think we have sent a message we are willing to go to trial." [wired.com]
If these kind of statements aren't proof that all they [RIAA] are doing is trying to do is extort people, I don't know what is.
Last year they went after Patricia Santangelo, PC-illiterate Long Island mother of five for sharing music, after her children had downloaded some music. When the RIAA couldn't make their case against her hold water... and after running her into debt with legal fees... the RIAA went after her children directly and ultimately filed suit against the kids after getting the daughter and a neighbor to admit to using Kazaa.
The RIAA went after Tanya Andersen, a disabled single mother, for file sharing "gangster rap" which she says she doesn't listen to at all, in 2005. The RIAA tried to contact her then-seven -year-old daughter without her knowledge in order to question her. She also claims that the RIAA demanded a four-figure settlement to resolve the case when it knew or should have known that she had done nothing wrong. She turned around and filed suit against the RIAA . The suit characterizes the RIAA and its affiliates as part of a larger criminal enterprise that violated the Racketeer Influenced Corrupt Organizations Act (RICO).
The RIAA has gone after university students threatening them with either paying a $3000 pre-litigation settlement or they can face a costly public trial.
However, I didn't see the RIAA going after music executive Edgar Bronfman Jr or his children after he publicly admitted that his own kids have been illegally downloading music.
After the hideous judgment against Jammie Thomas awarding $220,000 to the RIAA for 24 songs, I know I am going to make a conscious effort to not buy music from RIAA record labels by using RIAA Radar website.
